Job Description
AlphaStaffHCM is seeking a Corporate Paralegal – ERISA/Benefits, who will be a key member of the Legal team, who will support Company attorneys and the Company’s affiliated insurance agency on ERISA and federal tax laws relating to employee benefits, health and welfare plans, wellness initiatives, and 401(k) retirement savings plans, as well as oversee insurance agency compliance. This person must have demonstrated experience in ERISA and benefits compliance, as well as meticulous attention to detail and excellent verbal and written communication skills. Salary: $36.06-$38.46/hr, depending on experience and education Responsibilities Include, But Are Not Limited To Draft and review client and participant explanatory material (e.g., summary plan descriptions, announcement letters, summary of material modifications, plan documents, summaries of benefits and coverage, Client correspondence/bulletins regarding compliance and plan details, etc.). Monitor state and federal statutes and regulations applicable to group health plans and retirement plans. Manage Benefits Compliance Calendar and ensure adherence to applicable regulatory deadlines. Liaise with stakeholders and vendors to ensure information and data needed to complete regulatory filings are complete, accurate, and timely. Manage client, vendor, and carrier communication regarding plan administration and audits. Conduct compliance audits. Assist with internal investigations, IRS/DOL audits, and corporate transaction due diligence. Act as a liaison between attorneys, clients, plan administrators, vendors, and insurance carriers. Partner with the Company’s affiliated insurance agency to ensure operational compliance with best practices and help advise on the same. Provide compliance support for annual tax filings, required plan testing, operational reviews, and corrections. Conduct periodic operational compliance reviews concerning ERISA, Mental Health Parity and Addiction Equity Act, Affordable Care Act, HIPAA, and other federal health laws. Assist internal business units with interpreting and applying legal developments on all aspects of the Internal Revenue Code, ERISA, and other relevant laws as they affect employee benefits plans and fiduciaries of benefit plans. Consult and advise on plan qualification and fiduciary responsibility issues. Coach and train benefits specialists as needed. Be responsible for and master the company and affiliate insurance agency’s master policies and broker agreements, as well as ancillary agreements. Regularly engage with company, attorneys, and stakeholders regarding details of such policies. Complete other duties as necessary or assigned to facilitate the Company’s legal needs and accomplish its business goals. Qualifications Education & Experience: Bachelor of Science degree with a minimum of 3 years of relevant experience on ERISA and related health legislation and regulations; experience with a professional employer organization, health plan insurance carrier, or employee benefits insurance broker is a plus. Knowledge of and/or expertise in state and local paid leave laws, Public Health Service Act and related health legislation and regulations, Medicare, Medicare Part D, and Medicare Advantage Programs, including Employer Group Waiver Plans. Paralegal certificate (preferred). Leadership presence. Excellent client management skills. Superb analytical and problem-solving skills. Excellent oral and written communication skills. Must be exceptionally organized, detail-oriented, and efficient. Must be able to strike a sensible and practical balance between legal risks and business needs. Skills & Competencies Attention to Detail: Produces accurate plan documents, participant communications, and regulatory filings; maintains meticulous version control. ERISA/Benefits Compliance Acumen: Interprets and applies ERISA, ACA, HIPAA, MHPAEA, COBRA, and related guidance to support compliant plan administration. Document Management: Drafts and updates SPDs, SMMs, SBCs, notices, and client correspondence; manages templates and document repositories.
